By accessing or using the Payledger platform, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use our services. These terms constitute a legally binding agreement between you and Payledger Inc. We may update these terms from time to time, and continued use of the platform after changes constitutes acceptance of the revised terms.
To use our services, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must be at least 18 years old to register. We reserve the right to verify your identity and may require additional documentation to comply with regulatory obligations.
Payledger charges fees for certain transactions, which will be clearly displayed before you confirm a transfer. Our fee schedule is transparent and may vary based on payment corridor, transaction volume, and currency pair. All fees are denominated in the source currency of the transaction. We may adjust fees with advance notice. You are responsible for any taxes applicable to your use of the platform.
You may not use the Payledger platform for any illegal activity, including money laundering, terrorist financing, fraud, or sanctions evasion. Other prohibited activities include operating unregistered money services businesses, engaging in deceptive practices, attempting to circumvent our compliance controls, and using automated tools to abuse our systems. Violation of these prohibitions may result in immediate account termination.
To the maximum extent permitted by law, Payledger and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim shall not exceed the total fees paid by you in the twelve months preceding the claim. This limitation does not apply to liability for gross negligence, fraud, or willful misconduct.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California, unless otherwise agreed by both parties.
